General Contract Conditions

ticket.maxxi.archeoares.it is a platform for the provision of online booking and pre-sale services (the "Service") of tickets for access to museums, exhibitions and cultural events or entertainment in general.

Pursuant to and for the purposes of Article 49 of the Consumer Code, we hereby inform you that the provider of the Service ticket.maxxi.archeoares.it and owner of the ticket.maxxi.archeoares.it platform is the company Archeoares S.n.c. Servizi per i beni culturali e l'editoria, operational headquarters piazza San Lorenzo 8, 01100 Viterbo. VAT no. 01318460555 ("Supplier").

The general contract conditions (the "General Contract Conditions") governing the ticket.maxxi.archeoares.it Service are specified below, acceptance of which by the Customer (as defined below) is an essential condition for the Customer to be able to validly use the ticket.maxxi.archeoares.it Service. The General Terms and Conditions of Contract govern the relations between the Customer and the Supplier in the use and enjoyment of the ticket.maxxi.archeoares.it Service:

1. Definitions

1.1. Customer: is the person who uses the ticket.maxxi.archeoares.it Service to purchase one or more Access Certificates.
1.2. Consumer Code: is Legislative Decree No. 206 of 6 October 2005 as amended and supplemented.
1.3. Service Fee: is the surcharge applied by the Supplier on the Face Price of the Access Securities and constitutes remuneration for all or part of the Service ticket.maxxi.archeoares.it. It is indicated to the Customer during the procedure for purchasing the Access Licence and is invoiced directly by the Supplier to the Customer.
1.4. Ticket.maxxi.archeoares.it Service Contract: this is the contract established between the Supplier and the Customer for the provision of the ticket.maxxi.archeoares.it Service and its use by the Customer.
1.5. Contract of Sale: is the contract that is established between the Customer and the Organiser for the sale of the Access Ticket through the ticket.maxxi.archeoares.it Service, to be understood as governed by these General Contract Conditions in the parts referring to the use of the Event, by the applicable provisions on the subject of sales in accordance with the applicable Italian regulations and by the warnings on the back of the purchased Access Ticket.
1.6. Consumer: is the physical person Customer who uses the ticket.maxxi.archeoares.it service to purchase Access Licences for purposes unrelated to any professional or entrepreneurial activity carried out.
1.7. Advance Sale Fee: this is the eventual surcharge applied by the Organiser in the case of advance sale of the Access Ticket. It is an integral part of the Facial Price of the Access Ticket purchased by the Customer and is indicated on the Access Ticket separately from the Nominal Value of the Access Ticket.
1.8. Event: is the event, show or performance to which the Access Ticket relates.
1.9. Organiser: is the entity that organises the Event for which the Access Ticket has been issued. Supplier in the sale of the Access Ticket through the ticket.maxxi.archeoares.it service acts in the name and on behalf of the Organiser. Pursuant to and for the purposes of Article 49 of the Consumer Code, the data and references of the Organiser are indicated to the Customer before the purchase is finalised and are shown on the Access Ticket.
1.10. Facial Price: is the price composed of the Nominal Value plus the eventual Advance Sale Right and is shown on the Access Ticket.
1.11. Ticket.maxxi.archeoares.it Service: is the set of services for booking, issuing and making the Access Ticket available to the Customer through the ticket.maxxi.archeoares.it sales network. The ticket.maxxi.archeoares.it service does not include the sale of the Access Ticket and/or the provision of the service consisting in the Event, which remain the exclusive acts and/or obligations of the Organiser, in whose name and on whose behalf the Supplier acts by exclusively providing the ticket.maxxi.archeoares.it service.
1.12. Holder of the Access Ticket: the person who legitimately and in accordance with these General Contractual Terms and Conditions holds an Access Ticket bearing his/her name where the Access Ticket is nominative.
1.13. Access Ticket: is the document, also in digital format, having fiscal value, purchased by the Customer through the Service ticket.maxxi.archeoares.it that legitimises the holder of the Access Ticket to access the Event. The Access Ticket is of a strictly personal nature and cannot be transferred for valuable consideration or be the subject of intermediation, in compliance with tax regulations (decree 23/07/2001 and subsequent amendments and integrations). Access Securities may not be replaced if they are lost, lost, deteriorated, damaged, destroyed or stolen.
1.14. Nominal Value: is the price of the Access Security net of the Advance Sale Fee and Service Fee.

2. Purpose of the Service ticket.maxxi.archeoares.it

2.1. These General Contract Conditions regulate the supply and use of the ticket.maxxi.archeoares.it Service and, therefore, the supply to the Customer of booking and pre-sale services for Access Tickets relating to the Event organised and managed by the Organiser.
2.2. Within the scope of the Contract of Sale, the Supplier acts in the name and on behalf of the Organiser by exclusively providing the ticket.maxxi.archeoares.it Service, for which it is not responsible for the organisation, management or even less the pricing policy of Access Tickets, their promotion and distribution.
2.3. The ticket.maxxi.archeoares.it service provided by the Supplier is a reservation and presale-only service for Access Tickets to published Events. In concluding the Contract of Sale, as well as in the communication activities relating to the Event, the Supplier acts in the name and on behalf of the Organiser and the only service it provides is that of providing the ticket.maxxi.archeoares.it Service.

3. Duration of Reservations

3.1. The ticket.maxxi.archeoares.it service allows a limited period of time for the payment of booked Access Tickets (hereinafter the "Booking Time").
3.2. The Reservation Time is clearly indicated on the summary page of the shopping cart, marked by the icon indicating the exact time limit within which the payment of the Access Ticket can be made.
3.3. The purchase of the Access Ticket must be made by persons of legal age. The system does not allow the on-line purchase transaction to be concluded if performed by Customers under 18 years of age.
3.4. The total price payable by the Customer for the Access Licence, including the Facial Price and any Service Fees, which are indicated separately, is specified immediately before the purchase and the Customer must accept it by deciding to complete the purchase.

4. Cancellation of Reservations due to Non-Completion of Transaction

4.1. The purchase of the Access Ticket must be made within the Reservation Time indicated by the system.
4.2. Once the Reservation Time has elapsed without the Customer having made payment for the booked Access Ticket, the relevant reservation will be cancelled and the Access Ticket will automatically return to the sales circuit.

5. Terms of payment and conclusion of the contract

5.1. The method of payment for Access Licences is indicated on the sales page by the system and is also indicated immediately prior to payment.
5.2. The Supplier reserves the right, for security reasons, to apply limitations and exclusions to the payment instruments that may be used by the Customer for payment.
5.3. It is specified that in the case of payment by credit card, the Customer has X payment attempts available for each transaction code. If the payment attempts are unsuccessful, it will no longer be possible to recover the transaction. In this case, please use the Support form.
5.4. Immediately before payment, the Customer shall accept these General Terms and Conditions.
5.5. The Service Agreement ticket.maxxi.archeoares.co.uk as well as the Sales Agreement is concluded upon receipt of the email communication summarising the purchase and on condition that the payment has been successfully completed.
5.6. If the payment is successful, the system shall display online the purchase receipt, which shall bear the indication "Payment Confirmed - Transaction Complete" as confirmation of the purchase made by the Customer.
5.7. Shortly after completion of the transaction, the Customer will receive an email confirming the purchase made, specifying the seats assigned, the price paid and the method of collecting the selected Access Ticket. The Supplier declines all responsibility for the non-delivery of the confirmation email within the aforementioned terms, if delivery was not possible due to the Customer entering incorrect or invalid data in the on-line form requesting the Customer's personal data.
5.8. The Customer may always print a receipt for the purchase made by entering the Private Area in the My Orders section.
5.9. With the acceptance of these General Contract Conditions and with the successful conclusion of the purchase process and the making of the relevant payments by the Customer, the Customer expressly acknowledges, agrees and accepts that the ticket.maxxi.archeoares.it Service provided by the Supplier is a service for the pre-sale only of Access Tickets to published Events. In concluding the Contract of Sale, as well as in the communication activity relating to the Event, the Supplier acts in the name and on behalf of the Organisers and the only service provided by the same in its own name and on its own behalf is that of pre-sales.

6. Security

6.1. In order to guarantee maximum security, online transactions of purchases with the ticket.maxxi.archeoares.it service are carried out through a secure server, with COMODO CA Limited certification, which adopts the SSL (Secure Socket Layer) protection system, according to which the Supplier is never made aware of the codes used by the Customer to activate their card, but only receives a receipt number from the third party manager of the electronic payment platform confirming the successful completion of the transaction at the end of the transaction.

7. Collection and delivery methods

7.1. In the case of an online purchase, the Customer has the choice between:

  • Shipment of the Access Licence to his domicile at his own expense, which shall be announced at the time of purchase;
  • Collection of the Access Ticket at the ticket office at the venue of the selected Event from one hour before the start of the Event by presenting the payment receipt or the number of your transaction code and, where required by law, an identity document;
  • For some Events, a printout of the Access Ticket ("ticket.maxxi.archeoares.it") may be available at home.

7.2. If shipment to one's domicile is requested, delivery of the Access Ticket will be made by express courier at the Customer's expense. The costs of shipment as well as its essential characteristics are indicated when the Customer chooses the relevant option. If delivery to the Customer's home address is requested, the Supplier shall not be liable for the non-delivery of the Access Licence if the delivery is not possible due to the Customer entering incorrect or invalid data in the Customer's online application form.
7.3. If printing is requested at home or the handling of the Access Ticket in digital format, the Customer shall adopt all the specifications indicated and related to the purchase procedure in the section dedicated to the Event on ticket.maxxi.archeoares.it.

8. Exclusion of the right of withdrawal

8.1. Pursuant to Article 59, paragraph 1, letter n) of the Consumer Code, the right of withdrawal referred to in Articles 64 et seq. of the same Consumer Code is not applicable to transactions carried out through the ticket.maxxi.archeoares.it Service. In fact, the Consumer acknowledges that since the Service Contract ticket.maxxi.archeoares.it and the Sales Contract concern products and services relating to free time to be supplied at a specific date or period of performance, the right of withdrawal referred to in article 52 of the Consumer Code does not apply.

8.2. Service Contract ticket.maxxi.archeoares.it concerns a service, the ticket.maxxi.archeoares.it Service, which the Customer uses at the time of purchase.
8.3. Under no circumstances will the Supplier reimburse either the Face Price of the Access Tickets or any Service Fees and/or the Advance Sale Fee, or any shipping costs, in the event that the Customer renounces access to the Event.

9. Postponed or Cancelled Event, Event-related Inefficiencies

9.1. In the event of an event being cancelled or postponed by the Organiser, or in the event of inefficiencies relating to the Event and/or the Sales Agreement, the Customer must apply exclusively to the Organiser to request the refund of the Face Price of the Access Tickets purchased through the ticket.maxxi.archeoares.it Service and/or for compensation for any damages suffered and to be suffered and for any other costs that may have been incurred, without prejudice to the Supplier's right to the Service Commission as it relates to a service, the Advance Sale Service, that has already been performed. The Customer acknowledges that the reimbursement does not include any shipping costs of the Access Licence, if already incurred by the Supplier.
9.2. The Supplier, since it is neither the organiser nor the supplier of the Event, cannot be held liable in any way for any variations in the programme of the Events published through the ticket.maxxi.archeoares.it Service and, to this end, it is recommended to always check the characteristics of the scheduled Events directly on the official site and/or on the communication channels of the Organiser.
9.3. The Supplier may not, moreover, be held liable for any inconvenience, inconvenience or disservice suffered by the Customer due to events due to the Organisers and in the event of cancellation or postponement by the Organisers of the Event for which through the ticket.maxxi.archeoares.it Service it has provided the service to purchase the relative Access Ticket, without prejudice to its own liability for fault or fraud with regard to what is included in the ticket.maxxi.archeoares.it Service (for example, the dissemination of misleading information for reasons attributable to it). Reimbursement of the Face Price must be requested directly from the Organisers.

10. Access to the ticket.maxxi.archeoares.it service

10.1. In order to access and use the ticket.maxxi.archeoares.it Service, the Customer is required to

  • i. accept these General Terms and Conditions in their entirety
  • ii. complete the on-line form requesting the Customer's personal data, authorising their processing by the Supplier in accordance with the Privacy Policy published on www.ticket.maxxi.archeoares.it.it. By accepting these General Terms and Conditions, the Customer undertakes to keep his registration data constantly updated and guarantees that they are valid, true, accurate and correct and do not violate the rights of third parties.

10.2. The Supplier reserves the right to allow access to the ticket.maxxi.archeoares.it service at any time exclusively to Customers who have previously successfully completed a registration procedure at www.ticket.maxxi.archeoares.it.it. Access credentials are personal, may not be used from two locations at the same time and may not be transferred or given to third parties. The Customer shall be entirely responsible for all operations performed using its credentials and it shall therefore be the Customer's obligation to keep these data strictly confidential and secret, notifying the Supplier immediately if they are used without the Customer's authorisation.
10.3. The Supplier shall not be held liable in any way for any incorrect or illegitimate use of the credentials by the Customer or any third party where this is not his fault.
10.4. The Supplier also reserves the right to inhibit a Customer's access to the ticket.maxxi.archeoares.it Service as well as to discontinue the operation of his access credentials immediately and without prior notice in the event that it considers that there is a substantial breach of the provisions of these General Terms and Conditions, in particular if it finds that:

  • i. the Customer's data are incorrect, also due to the Customer's failure to update them
  • II. liability related to the unlawful use of credentials has occurred;
  • III. in the event of distorted use or use for illicit purposes of the ticket.maxxi.archeoares.it service by the Customer.

11. Complaints

11.1. For any observation or complaint regarding the ticket.maxxi.archeoares.it service, please use the Customer Service form.

11.2. Comments from users are always very useful, as they are an important opportunity for discussion that enables us to offer a service that is increasingly in line with users' needs.

12. Linking to other sites

12.1. In relation to any links other than www.ticket.maxxi.archeoares.it.it present within its own web pages, it should be noted that the Provider cannot be held responsible in any way for the opinions and content expressed on such sites.
12.2. Such sites may be modified, moved or deleted by their legitimate owners without any notice being given to the Supplier.

13. Supplier's liability

13.1. The Supplier is only and exclusively liable for expenses and damages incurred by virtue of its own fault or malice in relation to the ticket.maxxi.archeoares.it Services provided by it, as well as for any erroneous information negligently provided in relation to the Event.

14. Competent court

14.1. For any dispute concerning on-line purchases made by a Customer as a consumer using the ticket.maxxi.archeoares.it service, the competent court is the court of the place of residence or elective domicile of the consumer.
14.2. In all other cases in which and therefore where the on-line purchase is not made by a non-consumer Customer, any dispute concerning the validity, interpretation, execution and/or termination of legally relevant acts related to the contract of the ticket.maxxi.archeoares.it Service shall be referred to the exclusive jurisdiction of the Court of Rome.

I hereby declare that I have read the general terms and conditions of sale and that I expressly approve the following clauses, pursuant to and for the purposes of Articles 1341 and 1342 of the Italian Civil Code: Art. 1.12 (non-issuance of replacement tickets in the event of loss, deterioration, damage, destruction or theft); Arts. 3.1-3.2 (duration of the Reservation Time); Art. 7 (Supplier not responsible in case of non-delivery of the confirmation e-mail due to wrong communication of the user's data); Art. 7.2 (Supplier not responsible in case of non-delivery of the Access Licences by express courier due to wrong communication of the user's data); Art. 9.1 (Supplier not responsible for the refund of Access Licences to cancelled or postponed events and obligation of the user to contact the Third Party Organisers); Art. 9.2 (Supplier not responsible for variations of events and Supplier's unprejudiced right to the service fee); Art. 9.2 (Exclusion from reimbursement of shipping costs, if already borne by the Supplier, of Access Licences to cancelled or postponed events); Art. 9.3 (Supplier not responsible for damages to the user for cancellation of events); Art. 10.1 (User's obligation to keep his data updated and valid); Art. 10.3 (User's obligations with respect to Login and Password); Art. 10.4 (Supplier's right to inhibit access to the ticket.maxxi.archeoares.it Service in relation to illegitimate use of Login and Password); Art. 14.2 (Exclusive jurisdiction for non-consumer users).
